1. What these terms cover — and what they do not
These are the terms of use of the website palpito.audio. They govern your use of the site and of what we make available through it:
- the pages of the site, including the community pages and the listening tests;
- the free download of the Palpito application;
- any other material we publish here.
### ⚠️ These are NOT terms of sale We do not sell anything on this website. If you buy Palpito Pro, the sale is made by Paddle acting as merchant of record — Paddle is the seller, not us. Everything about a purchase is governed by Paddle's own terms, hosted on Paddle's side: the contract of sale, payment, invoicing, taxes and VAT, and the refund policy. See section 8 below.
Using this site means you accept these terms. If you do not accept them, please do not use the site.
2. Who we are
The site is operated by Palpito Audio, the trading name of an individual author established in Italy. We are reachable for any matter concerning the site at supporto@palpito.audio. The operator is identified in full in section 13.

3. Acceptable use
You may read, use and share the site freely for your own lawful purposes. You agree not to:
- interfere with the site's operation, security or availability, or attempt to gain unauthorised
access to any part of it or to the systems behind it;
- circumvent, disable or probe the download system, the anti-abuse checks, or any technical measure
protecting the application or a licence;
- use automated means to scrape, harvest or bulk-download the site or the application, or to submit
forms automatically;
- redistribute the application, host it elsewhere, or share download links issued to you — each link
is personal, single-use and expires after 48 hours;
- submit an email address that is not yours, or otherwise impersonate anyone;
- use the site to distribute unlawful, infringing or malicious content.
We may suspend access to the site or to the download system where it is necessary to protect the service or other users.
4. The free application
Use of the Palpito application — both the free edition and Palpito Pro — is governed by the End User Licence Agreement, published at palpito.audio/eula/. These terms of use cover the website; the EULA covers the software. Where the two differ about the application, the EULA prevails.
What follows is a summary for convenience and does not replace the EULA. The free application is made available to you free of charge, and we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use it on computers you own or control, for your own purposes — including commercial music work. Whatever you create with Palpito is yours: we claim no rights in your music, your MIDI files or your projects.
You may not redistribute, resell, rent, sublicense or publish the application, nor reverse engineer, decompile or disassemble it, except to the extent that such restriction is prohibited by applicable law — in particular the rights reserved to lawful users by articles 64-ter and 64-quater of Italian Law 633/1941, which neither these terms nor the EULA limit.
Palpito Pro unlocks additional features with a licence file issued on purchase. That licence is governed by the same End User Licence Agreement at palpito.audio/eula/. The sale is not ours: it is made by Paddle as merchant of record, under Paddle's own buyer terms — see section 8.
The application is under active development and is currently offered as a beta. It is provided as is: we make no promise that it is free of defects, that its output will suit any particular project, or that any feature will remain unchanged.
Keep your own backups. Palpito writes MIDI files. Always keep a copy of anything you value before processing it.
5. Third-party components in the application
The application includes third-party open-source components, each distributed under its own licence and remaining the property of its respective owners — including Qt / PySide6 (© The Qt Company Ltd.) and mido. Those licences continue to apply to those components, and nothing in these terms overrides them.
6. Intellectual property
The site and its content — text, page design, graphics, audio examples, videos and documentation — belong to Palpito Audio and are protected by copyright. You may quote or link to them with attribution; you may not republish them wholesale or present them as your own.
The application is a work of authorship of Andrea Pierantoni, published under the Palpito Audio name. All rights in it are reserved.
"Palpito" and "Palpito Audio" are used as the names of this product and of its author's activity.
Sample libraries and instrument names mentioned on this site — the orchestral libraries Palpito generates controller curves for — belong to their respective owners. We are not affiliated with, endorsed by, or sponsored by any of them. Their names are used only to describe what Palpito is compatible with, which is what those names are for.
The music you make is yours. We claim nothing in the MIDI you process or the recordings you produce.
7. Listening tests, community pages and anything you send us
The listening tests are for demonstration. The audio examples are ours or are used with permission, and may not be extracted or reused separately from the page.
If you send us feedback, a bug report or a suggestion, you allow us to use it to improve Palpito without obligation or payment. Please do not send us anything confidential or anything you are not free to share.
8. Purchases are made by Paddle — not by this website
Palpito Pro is sold by Paddle.com Market Ltd as merchant of record. This means Paddle is the seller of record to you, and the following are entirely Paddle's, hosted and governed on Paddle's side under Paddle's own terms:

If your question is about a purchase — a refund, an invoice, a payment, a chargeback — please use the route on your Paddle receipt. Writing to supporto@palpito.audio will only delay you: we have neither the payment data nor the ability to act on it.
What we do after a purchase is issue and deliver your Palpito Pro licence file, and support the application itself. For that, and only that, supporto@palpito.audio is the right address.
9. Availability, and no warranty for the site
We try to keep the site available and its content accurate, but we do not guarantee that it will be uninterrupted, error-free, or up to date. Content may change or be withdrawn at any time. Audio examples, figures and descriptions of the application illustrate what it does; they are not promises about a specific result on your material.
To the fullest extent permitted by law, we exclude liability for loss arising from use of the site or of the free application. Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud, and any liability under mandatory consumer-protection law.
10. Links to other sites
The site links to third parties — Paddle, our email provider, social platforms and others. We do not control them and are not responsible for their content or their practices. Their terms and privacy notices apply when you are there.
11. Changes to these terms
We may update these terms. The "last updated" date above will change. Continuing to use the site after a change means you accept the updated terms; if you do not, please stop using the site.
12. Governing law
These terms are governed by Italian law. If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of the country where you are habitually resident, and you may bring proceedings in the courts of that country. For anything concerning a purchase, the governing law and dispute rules are those in Paddle's terms, not these.
